CYWX terms of use
Terms.
CYWX is an advisory tool for pilots. It is not an official weather briefing source, and it is not a substitute for one. These are the terms you use it under.
Not an official weather briefing.
CYWX retrieves and decodes published aviation weather so it is quicker to read. It is advisory only. It is not an official pre-flight briefing, it is not a flight planning service, and it does not satisfy any regulatory requirement to obtain a briefing before flight.
Always obtain an official briefing from NAV CANADA or your Flight Information Centre, and verify anything CYWX shows you against the official source before you act on it. As pilot-in-command, the decision to fly, and the responsibility for it, remain entirely yours.
Where the weather comes from.
Observations, forecasts, NOTAMs, upper winds and imagery are retrieved directly from the published aviation weather services for the region you ask about. We do not produce this data and we do not control it.
It may be delayed, incomplete, amended after you retrieve it, or unavailable altogether. Decoding is a convenience: where a decoded value and the raw report disagree, the raw report is the authority, and CYWX always shows it in full.
Using CYWX.
You may use CYWX for personal, non-commercial purposes. Do not reverse engineer, copy or redistribute the app or its contents, and do not use it in a way that places an unreasonable load on the weather sources it draws from. The app is also subject to Apple’s standard licence terms for App Store applications, which these terms supplement.
CYWX Pro.
CYWX Pro is an auto-renewing subscription offered monthly or yearly. The price is the one shown in the App Store for your region, and it is charged to your Apple Account when you confirm the purchase. The yearly plan includes a three-day free trial for new subscribers; if you subscribe before the trial ends, the unused portion of it is forfeited.
A subscription renews automatically unless it is cancelled at least 24 hours before the end of the current period, and your Apple Account is charged for renewal within the 24 hours before that period ends. Manage or cancel a subscription in your Apple Account settings. Purchases and refunds are handled by Apple under Apple’s terms; we cannot issue refunds ourselves.
No warranty.
CYWX is provided “as is”, without warranties of any kind. We do not warrant that it will be available, uninterrupted, or free of error, or that the weather information it shows is accurate, current or complete.
Limitation of liability.
Timko Labs Inc. is not liable for any damages arising from your use of CYWX, including but not limited to any decision made or not made on the basis of information shown in the app.
Changes.
These terms may change from time to time. Continuing to use CYWX after a change means you accept the revised terms, and the revised date below changes with them.
Governing law.
These terms are governed by the laws of British Columbia, Canada, and the laws of Canada applicable in it.
